When an individual passes away, their estate must be collected, managed and distributed by a living person. If the decedent had a will, their will most likely named an executor. If the decedent did not have a will, then the court will appoint a personal representative for him or her.

When someone dies, their executor takes inventory, or documents all of the decedent's assets, and informs the decedent's creditors that the decedent has died. After the will has been verified by the courts and the creditors' claims have been dealt with, the executor then distributes the assets accordingly. If the will is invalidated by the courts or the decedent left no will, the courts will distribute the assets according to state laws.

In Oklahoma, the law of decent and distribution decides where assets go after the death of an individual with no will. If there is no prenuptial agreement, the surviving spouse usually receives one-half of all the property of the decedent and the surviving children divide the remaining one-half in equal shares. If a child has died before the decedent and the deceased child is survived by a child or children, those grandchildren will receive equal shares of the portion of the estate that their parent would have received if living.
