Probate is the legal process of administering the estate of a deceased person, resolving all claims against the estate and distributing the decedent's property according to a will. The first priority for the probate court is to decide upon the legal validity of the will, and upon validating the will, the court appoints an executor or personal representative, which is generally the person named in the will. The executor or personal representative has the legal power to dispose of the decedent's assets in the manner that is specified in the will.

Once the will is proved to be valid, the property can be retitled or transferred to the beneficiaries listed in the will. Probate administration is a very involved process that includes many different technical aspects including but not limited to:

  • Creditors must be notified and legal notices have to be published.
  • Executors will need to become informed of when and how to distribute assets while taking creditors' rights into account.
  • Homestead property will need to be dealt with separately from other assets.
  • There may be a lawsuit pending in regards to the decedent's death, and there may be separate procedures required for contentious probate cases.
  • Real estate may need to be sold to pay debts or correct the distribution of assets.
  • If the estate exceeds certain thresholds, it may be necessary to consider estate taxes, gift taxes and inheritance taxes.
  • Other assets will need to be transferred from the deceased to his or her beneficiaries such as life insurance.
