Oklahoma City Divorce Attorney

Are you headed towards divorce?

If you are presently contemplating divorce or if your spouse has already served you divorce papers, it's important that you speak with an Oklahoma City divorce attorney as soon as possible. The divorce process is well-known for being one of the most stressful experiences an adult will ever have to go through, and therefore requires guidance from a qualified professional throughout the process.

The petitioner or respondent in the divorce action must be an actual resident of Oklahoma for a period of six (6) months immediately prior to filing the divorce petition. An action for an annulment or a divorce or a legal separation may be filed in the county in which the petitioner has been a resident for (30) days preceding the filing of the petition, or it can be filed in the county in which the respondent is a resident. The District Court may grant a divorce for any one of the following reasons:

  • Abandonment for one year
  • Adultery
  • Impotency
  • When the wife at the time of marriage became pregnant by a man, other than her husband
  • Extreme cruelty
  • Fraudulent contract
  • Incompatibility
  • Habitual drunkenness
  • Gross neglect of duty
  • Imprisonment in a state or federal institution for the commission of a felony
  • Insanity for a period of 5 years

The state of Oklahoma is an equitable distribution state, meaning that the court shall distribute the property in a manner that is deems fair and just. In an Oklahoma divorce, either spouse may be entitled to spousal support depending upon the circumstances of the case. However, voluntary cohabitation of a former spouse with a member of the opposite sex shall be grounds to modify such support, and death or remarriage of the recipient shall terminate the spousal support payments.

When minor children are involved, the court may award child custody to either the mother or the father or to the parents jointly. When awarding custody to either parent, the court shall make a determination that is in the child's best interests.

Child support is typically awarded in accordance with Oklahoma's child support guidelines; however, the court may deviate from the amount indicated in the child support guidelines under certain circumstances.
